SCC general assembly orders the return of removed judges
Published in Daily News Egypt on 26 - 12 - 2012

In a meeting held Wednesday, the Constitutional Court's general assembly ruled on article 233 of the new constitution, which stipulates that judges who have been removed from the court must return to their previous posts. This meant that four judges would return to work as commissioners, a fifth would return to the Court of Cassation, while a sixth would return to the Cairo Court of Appeals.
The general assembly of the Constitutional Court also ruled that all current advisors to the court's vice president (Ragab Selim, Hamdan Fahmi, Mahmoud Ghoneim and Hatem Bagatu) would return to their posts as commissioners within the Supreme Constitutional Court of Egypt, where they worked previously before being joining the Constitutional Court.
It was also decided that Hassan El-Badrawi would return to serve as the vice president of the Court of Cassation, and that Boulos Fahmi would return to his previous post at the Cairo Court of Appeals, the last two institutions that both worked at before being inducted into the Supreme Constitutional Court of Egypt.
These decisions were based on article 176 of the Constitution, which ruled that the Constitutional Court would consist of a president and 10 members. This meant that it would be necessary to remove seven members seeing as the court currently consisted of a president and 17 members. Article 233 of the new constitution states that members who are removed from the Constitutional Court are to return to their previous posts.
