CAIRO: Youm7 exclusively obtained the full text of the investigation with former Egyptian president Hosni Mubarak. The questioning took place during Mubarak's detention at Sharm el-Sheikh International Hospital. The investigation lasted 42 days, from April 12, 2011 to May 24, 2011. Judge Mustafa Suleiman was tasked with investigating Mubarak. The questioning was conducted in Mubarak's hospital room, No. 390. According to the investigation, the deposed president was suffering from poor memory. The Judge Suleiman began the investigation at 9:30 am on April 12, 2011. He traveled to Sharm el-Sheikh to determine whether Mubarak's condition was stable enough to go to Torah Prison for questioning. At that time, Mubarak was in his Sharm el-Sheikh home with his family. Six hours later, the judge received a medical report saying Mubarak suffered from atrial fibrillation and should be transferred to a hospital. However, This did not prevent the investigation. Judge Suleiman questioned Mubarak on his role in killing demonstrators during Egypt's January 25 Revolution, stealing state money and taking bribes for illegal duties. Mubarak denied all accusations, saying, “I would never participate in killing any Egyptian citizen, I would never steal state money and I did not gain anything illegally.” Killing the demonstrators: Suleiman: What are the details of the demonstrations that took place from January 25, 2011 to February 11, 2011? Mubarak: Before January 25, I received information from the Minister of Interior that there will be a protest on January 25. I gave an order to not use violence with demonstrators, and not to use weapons or ammunition. The demonstration actually broke out in Cairo, I think, in Alexandria and somewhere else, as well as there was a small number of demonstrators. The Minister of Interior (Habib al-Adly) told me the demonstrators would leave at midnight and if they did not comply, the water hoses would force them to leave. I was not informed that they were killing and injuring people. On January 26 and 27, the demonstrators took place also but I do not remember in how many governorates they took placed. I also was not informed that there were dead and injured people. As for the demonstration on January 28, I was informed that the security forces were being beaten and had no weapons to defend themselves, so they ran away and the situation became dangerous. Consequently, I ordered the military troops to help the security forces in order to control and preserve the streets without using violence or weapons. On February 2, I saw a camel run among the demonstrators. I was amazed, and then I learned it was called “the Battle of the Camels.” Later on the situation calmed down but the demonstrators' demands increased and the security lost control. I delivered two speeches to the people and asked the Military forces to intervene to control the street and do the same role of the security forces. But because of their duties, they failed to do so, as it is not their duty. When I found this mission is heavy on the Military Forces and cannot do it because they are not qualified, I decided to leave the rule to the Supreme Council of the Armed Forces (SCAF) and I came to Sharm el-Sheikh. What are the contents of the reports and information you received on the demonstrations? At the beginning there were protests from different brackets of the society, then they started escalate in Cairo, and I think in other governorates. The protestors called for demands such as amending certain articles in the constitution, canceling the increasing corruption rate and presidential succession which is, in fact, unfounded. Where did you get this information from? Actually from the Minister of Interior, and then from the General Intelligence Services (GIS) which informs the Ministry on such matters. What is the means by which you received the information? Orally When did you know about the use of violence and force against the demonstrators? I knew from the Minister of Interior that the security forces were beaten and had no weapons so they ran away, but I was not informed that there were injured or killed people. Did not you know about this matter from the written or visual media means? I knew this news from the military forces and from news agencies. What is your evaluation of the demands of the demonstrations and how big the demonstrations were? Demonstrations were in small numbers, and the person who can answer this question is the Minister if Interior as he was responsible for the security. What are the measures you took as president toward the demonstrators and their demands at that time? After demonstrations broke out, I stared to achieve protestor's demands by firing the government and appointing a new one, and by all the known measures I did until I stepped down. I also announced that neither I nor anyone else in my family would run for the next presidential election. Why were the demonstrations' demands not met before its outbreak? Because I did not know these demands. What is your comment on the injured and killed people in Tahrir Square and other squares across the country? I cannot say a specific comment. Why did you not stop the violence against the demonstrators, who were in large numbers? There was chaos between two parties, and no one could take care about any decisions. Earlier protests The judge moved from the direct question to facing the ousted president with the former Minister of Interior Habib al-Adly's statements: The accused Habib el-Adly said in the investigation that the demonstrations against the regime and its policy started in 2005 over deterioration of political, economic and social situations, presidential succession, increase of the corruption, and demanded the fall of regime… what is your response? All these statements are baseless and I did not know them. In 2005, there were constitutional reforms and a ministerial reshuffle. Al-Adly said he informed you of this matter, and he recorded this in Cabinet meetings. I do not remember him telling me that except in the last period. What do you say about the lawsuits filed by the injured and the relatives of those killed saying security forces shot them with live bullets upon orders from you and the former minister of interior? All these claims are baseless. On the other side, the security forces had no weapons, and some demonstrators had weapons so the police forces ran away. What do you say about the fact-finding report conducted by the National Council for Human Rights that says you are responsible for the incidents of security confrontation against the demonstrators? All these statements are incorrect and prejudiced. What is your comment on using the same means to deal with demonstrators across the country? I do not know. I have no information that the police fired on the demonstrators. This news could be incorrect. Library of Alexandria: What are the circumstances of opening the account of the Library of Alexandria? In 1989, I remember that there were calling for restoring the old Library of Alexandria, and it needed donations since it cost a lot. So I called on figures such as the late French president Francois Mitterrand, Sheikh Zayed, and other foreign and Arab leaders to donate for the library. The Emir of the United Arab Emirates, Sheikh Zayed, donated $20 million [U.S. dollars]; the king of Saudi Arabia granted $20m; the former president of Iraq Saddam Hussein gave $21m; and finally, $5 million came from the sultan of Oman. I think donations totaled $70 million. The president is the only person who can put in or take out money from the account of the Library. I did not give power of attorney to anyone. The account was in Ahly bank. I did not take out credit except once or twice upon request from the library. Why are you only the responsible for the account? The library did not exist when the account was opened, and the money was raised to reconstruct it. Why did responsibility not go to the Ministry of Higher Education, to which the library is affiliated? So it would not be included in the State's balance sheet and not be misused by the Minister of Education. Why were the donations not transferred to the Library account in according with Law No. 1/2001? I did not know this matter and the legislators did not tell me. In addition, the general director of the library was not informed because if he knew, he would ask to take the donated money. Weapon Commissions: What is your role as a president in conducting weapons deals? Weapon deals are made between Egyptian Ministry of Defense and the U.S. Department of Defense (Pentagon) on required weapons in the framework of USAID. The military aid is allocated in the Pentagon balance. After inking the contracts, the Egyptian Ministry of Defense received the weapons, while the pentagon got money through the foreign companies. That means the president did not take any cash money linked to weapon deals. Mubarak's refrain was “no” when he answered any question related to charges against him. After the fist investigation, Judge Suleiman passed the following sentences against Muabark: • Detaining Mubarak for investigation; • Continuing the investigation the next morning; • Summoning the former General Intelligence Services chairman; • Getting the book concerning the account of the Library of Alexandria from the presidential office. The second investigation: What measures shall the president take when a demonstration breaks out? In case the demonstration is peaceful, according to international laws and agreements, the demonstrators shall be surrounded and left until they go. But if it is not peaceful, the violence will be used in a legal way. Did you hold any meeting with the concerned bodies? Yes, I hold meetings with certain officials. Who was at these meetings? The Prime Minister, the Minister of Defense and the Minister of Interior, but I dot not remember the others. What had happened in the meetings? I asked the ministers about the peoples' demands and ordered them to achieve these demands, and to deal peacefully with the demonstrators without using weapons. What are the demands you ordered to be achieved? Political demands like amending the constitution, especially the articles pertaining to presidential nominations and succession and dissolving Peoples' Assembly and Shura Council because the results of the former parliamentary elections. As for economic demands, they were related to high prices of commodities and imposing new ascending tax instead of unified tax.
