On Saturday, the Egyptian Lawyer Mohamed Hamed Salem filed the first challenge, before the Judiciary Administrative Court at the State Council, against the constitutional declaration released by President Mohamed Morsi. The challenge is calling for returning a verdict that cancels this constitutional declaration, which infringes the constitution and law. Moreover, President Mohamed Morsi has no right to release any constitutional declaration till drafting a permanent constitution for the country. The president can release constitutional declarations only in cases of necessity, but under complete judiciary supervision and after holding a referendum. The challenge elaborated that President Morsi has no way to entrench his decisions, except in case of canceling the State Council and the Supreme Constitutional Court. Also these decisions infringe the constitutional declaration issued on March 30, 2011. It is worth mentioning that President Mohamed Morsi has released a constitutional declaration last Thursday, providing for entrenching his decisions. Morsi has also sacked the prosecutor general Abdel Meguid Mahmoud, and appointed Talaat Abdallah. His decisions also prevent dissolving the Constituent Assembly to draft Egypt's new constitution.
