Chief of military justice, Adel al-Marsa said activist Alaa Ahmed Seif al-Islam Abdel-Fattah was not presented to the military prosecutor as an activist, but in capacity as an accused man. He was denied an appeal and is currently incarcerated pending trial for the following: 1. Theft of a weapon owned by the armed forces. 2. Intentional sabotage of funds and property owned by the armed forces. 3. Assaulting public servants. 4. Gathering, using force and violence against members of the armed forces. In accordance with military law, this places the case under the jurisdiction of military courts. It was pointed out Alaa Abdel Fattah is not the only defendant in the case of Maspiro clashes but there are others, both civilians and military and all are equal before the law. Al-Marsa issued an official statement on Thursday November 3 in which he said the right to fair trial is a constitutional right of each defendant. The independence of judiciary is the essence of justice and they will try this case in accordance with the law and the evidence presented before them.
